演唱会上自报“手机号”?张杰工作室道歉

9月9日,张杰工作室就福州演唱会上随口说出的电话号码引得众多粉丝拨打,从而给号主带来不便的问题发文道歉,称一直在积极联系机主,希望有机会能够直接致歉,目前正在协商解决方案。

工作室表示,“虚心接受大家的批评指正,接下来将全力做好补救措施,同时也恳请大家不要再去打扰机主。”

Chinese singer Zhang Jie's team apologized after the pop star casually mentioned a phone number during a recent concert, resulting in numerous fans calling the number and causing trouble for its owner. In a statement posted on Monday, Zhang's studio requested that fans refrain from calling the owner's phone. "We extend our sincerest apologies once again, to both the owner and anyone else affected by this," the statement read.

据网友爆料称,9月6日张杰福州演唱会的舞台互动环节中,张杰随口说出的号码引得众多粉丝打去电话。

这串号码前8位“19821220”正是张杰的生日,且正好为真实存在且在使用的号码,号主来自上海。号主因短时间内突然接到大量陌生电话,已经被迫关机。

During the stage interaction segment of Zhang's Fuzhou concert on Friday, he mentioned, "Will you call me? My number is 19821220***. Maybe I will receive your call tonight, maybe I will call you too." A portion of the number corresponds to Zhang's birth date. And it happened to be an active telephone number belonging to someone in Shanghai. Subsequently, the individual reportedly received multiple calls from Zhang's fans and had to switch off the phone.

此事引发网友热议,有人质疑为什么要随口编号码,“没想过这个号码可能真的存在吗?”“公众人物应该谨慎发言,应该考虑到万一这个号码真实存在带来的影响。”也有人认为这只是个巧合:“张杰也没想到是真的手机号,粉丝都知道这是开玩笑的。”

Netizens were left puzzled by this incident. "I'm curious why someone truly believed Zhang Jie would answer their call and actually dialed the number. What would you do if someone did pick up?" one netizen questioned. Another commenter added, "When he shared that number, he should have considered the potential consequences of people actually dialing it and the impact it might have on others. What if the owner of that number depends on their phone daily to communicate with clients? How would they handle the situation?"

根据《民法典》的规定,手机号码属于个人隐私的范畴,受法律保护。未经权利人同意,擅自使用、泄露或公开其手机号码,可能构成对隐私权的侵犯。

北京炜衡(成都)律师事务所知识产权专业委员会主任余龙表示,《民法典》第一千零三十二条规定,自然人享有隐私权。任何组织或者个人不得以刺探、侵扰、泄露、公开等方式侵害他人的隐私权。“但也可以看出,张杰的行为并非故意打扰他人生活安宁,而是在玩梗的时候疏忽大意,造成他人损害。因此作为主办方应当及时发布声明、澄清事实,以避免对他人侵犯隐私权的损害结果扩大。”

北京安剑律师事务所周兆成律师认为,张杰在演唱会上报出一串数字,本意可能是玩梗或者与粉丝互动,如果该手机号码并非张杰团队所有,尽管张杰主观上未必有恶意,但其行为客观上导致了其他人的隐私权受损,可能被认定为侵权行为。

According to the Civil Code, phone numbers are considered private and legally protected. Revealing someone's contact information without their consent, whether by using it, disclosing it, or sharing it publicly, can infringe upon their privacy rights. Attorney Zhou Zhaocheng from Beijing Anjian Law Firm suggests that when Zhang casually mentioned a series of numbers during a show, perhaps for amusement or to connect with the audience, he may not have intended any harm. However, if the number did not belong to his team, his actions could have potentially violated someone's privacy, which could be viewed as a legal transgression.
